Terms of Service

By accessing, browsing, or using Rate My Baseball Club (the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

These Terms constitute a legal agreement between you ("User," "you," or "your") and Rate My Baseball Club ("we," "us," or "our"). Your continued use of the Platform constitutes acceptance of any updates to these Terms.

Age Requirement: You must be at least 18 years of age to create an account. Users between 13-17 may use the Platform with parental consent but may not submit reviews.

Account Accuracy: You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials.

One Account Per User: Each user may maintain only one account. Creating multiple accounts to circumvent restrictions or manipulate ratings is prohibited.

Account Security: You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use.

Content Ownership: You retain all ownership rights to content you submit to the Platform, including reviews, ratings, and comments ("User Content").

License to Us: By posting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with operating and promoting the Platform.

Content Representation: You represent and warrant that:

• You own or have the necessary rights to your User Content
• Your User Content is based on firsthand experience
• Your User Content does not violate any third-party rights
• Your User Content complies with our Content Guidelines

Content Guidelines: All User Content must comply with our Content Guidelines. We reserve the right to remove content that violates these guidelines.

Moderation Process: We use a combination of automated systems and human moderators to review reported content. We aim to review all reports within 48 hours.

No Obligation to Monitor: While we moderate content, we have no obligation to monitor all User Content and are not responsible for User Content that violates these Terms.

Removal Rights: We reserve the right to remove any User Content at any time, for any reason, without prior notice.

Rate My Baseball Club is a platform for user-generated content. We are an interactive computer service provider under 47 U.S.C. § 230(c) (Section 230 of the Communications Decency Act).

Publisher Status: We are not the publisher or speaker of User Content. Reviews and ratings represent the opinions of individual users, not our opinions.

Good Faith Moderation: Our content moderation efforts are conducted in good faith and do not waive our Section 230 protections. We are not liable for User Content, even if we have been notified of potentially unlawful content.

Third-Party Claims: We do not verify the accuracy of User Content and are not responsible for any harm arising from User Content.

Our IP: The Platform, including its design, code, text, graphics, logos, and functionality, is owned by us and protected by copyright, trademark, and other intellectual property laws.

Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes.

Prohibited Uses: You may not:

• Copy, modify, or distribute content from the Platform
• Use automated systems to scrape data
• Create derivative works from our content
• Remove or alter any copyright notices

Trademark: "Rate My Baseball Club" and our logo are trademarks. You may not use them without our prior written consent.

You agree NOT to:

• Submit false, misleading, or fraudulent reviews
• Post defamatory, libelous, or harassing content
• Share personal information of others without consent (doxxing)
• Attempt to manipulate ratings or reviews
• Create fake accounts or impersonate others
• Use the Platform to promote spam, malware, or phishing
• Circumvent our anonymity protections to identify reviewers
• Interfere with or disrupt the Platform's operation
• Violate any applicable laws or regulations
• Encourage or facilitate any of the above prohibited conduct

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information.

Anonymity Protection: We use SHA-256 hashing to protect reviewer anonymity. We do not store email addresses in plaintext for reviews.

Data Rights: You have rights to access, correct, and delete your personal information as described in our Privacy Policy.

Cookies: We use cookies and similar technologies as described in our Privacy Policy.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Platform will be uninterrupted or error-free
• Warranties regarding the accuracy, reliability, or quality of User Content
• Warranties that defects will be corrected

No Endorsement: We do not endorse, verify, or guarantee the accuracy of any User Content or recommendations. Use of information from the Platform is at your own risk.

Third-Party Links: The Platform may contain links to third-party websites. We are not responsible for third-party content or practices.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE.

This includes damages arising from:

• Decisions made based on User Content or Platform information
• Unauthorized access to or alteration of your data
• Statements or conduct of any third party on the Platform
• Any other matter relating to the Platform

Aggregate Liability Cap: Our total liability to you for all claims arising from use of the Platform shall not exceed $100 USD or the amount you paid us in the past 12 months, whichever is greater.

Some jurisdictions do not allow limitations on liability. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

You agree to indemnify, defend, and hold harmless Rate My Baseball Club, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees) arising from:

• Your use of the Platform
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws

We reserve the right to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense.

Informal Resolution: Before filing a claim, you agree to contact us at legal@ratemybaseballclub.com to attempt informal resolution.

Binding Arbitration: Any dispute arising from these Terms or use of the Platform shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

Class Action Waiver: You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any class action, consolidated proceeding, or representative action.

Governing Law: These Terms are governed by the laws of the State of California, without regard to conflict of laws principles.

Venue: If arbitration is unavailable, any legal action must be brought in the state or federal courts located in San Diego County, California.

Opt-Out Right: You may opt out of arbitration within 30 days of accepting these Terms by sending written notice to legal@ratemybaseballclub.com.

By You: You may terminate your account at any time through your account settings or by contacting us.

By Us: We reserve the right to suspend or terminate your account or access to the Platform at any time, for any reason, including violation of these Terms or our Content Guidelines.

Effect of Termination: Upon termination:

• Your right to use the Platform immediately ceases
• We may delete your account and User Content (subject to legal obligations)
• Provisions that should survive termination remain in effect (including indemnification, disclaimers, and limitations of liability)

Appeal Process: If your account is terminated for violating our policies, you may appeal through our contact form.

We reserve the right to modify these Terms at any time. Material changes will be notified through:

• Email to your registered email address
• Prominent notice on the Platform
• Update to the "Last Updated" date

Acceptance of Changes: Continued use of the Platform after changes are posted constitutes acceptance of the modified Terms.

Rejection of Changes: If you do not agree to modified Terms, you must stop using the Platform and may terminate your account.

Entire Agreement: These Terms, together with our Privacy Policy and Content Guidelines, constitute the entire agreement between you and us.

Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

Waiver: Failure to enforce any right does not waive our right to enforce it later.

Assignment: You may not assign these Terms. We may assign our rights and obligations without restriction.

Force Majeure: We are not liable for failure to perform due to causes beyond our reasonable control.

Export Controls: You agree to comply with all export and import laws.

Government Users: The Platform is a commercial item subject to FAR 12.212 and DFARS 227.7202.
